BUTTE-Details remain murky in a Thursday morning shooting in Butte that left one man hospitalized.

The shooting, which was reported at approximately 8:30 a.m., was in the 500 block of West Galena St. in an apartment complex.

Butte-Silver Bow Sheriff Ed Lester said dispatch received a 911 call from a person who said their friend had been shot.

Lester said a 43-year-old man was shot in the chest with a handgun, he was taken to St. James HealthCare in critical conditions and later this afternoon his status was upgraded to stable condition.

“There was a male at the residence as well as a female as well as the individual who was shot. We are conducting interviews with them at this time, but nobody is charged or in custody at this time,” said Lester.

The detectives will investigate this incident to determine if there was any criminal intent or if there will be any charges connected to this shooting.

“When we’re finished with it we’ll submit the entire case to the Butte Silver-Bow County Attorney for review and see if there’s any probable cause to file any charges,” Lester said.

Some residents in the neighborhood were surprised by the shooting, many of them said they didn’t hear the shot.

“I had the TV on watching the flood in Houston, waking up and I had my box fan on in my living room and the TV so I didn’t hear anything,” said Ron Kish.

4-part series: Montana launching ambitious reforms to slow growth in prison, probation populations

$
0
0

This four-part series examines the extensive sentencing and correctional reforms passed by the 2017 Legislature, aimed at reducing Montana’s prison populations.

PART 1: Montana launches ambitious sentencing reforms, to slow prison populations

Montana has 15,000 criminal offenders on its books — an amount projected to grow in coming years. But in a bipartisan effort, state lawmakers this year enacted a sweeping set of initiatives that aim to reduce the number of Montanans in prison and on supervision.

The main thrust of the reforms is to cut the rate of criminal offenders who end up in prison, after being placed on probation or parole, by using better-targeted and better-coordinated treatment and a clear path for offenders to serve their time and get out of the system.

It’s an ambitious undertaking that involves not only the Corrections Department but also the entire criminal-justice system, from police to judges to probation officers to private correctional contractors. Those involved say it’s a huge task — and that the results won’t be known for some time.

PART 2: New professional parole board aims to ensure inmates succeed after prison

A key part of the criminal justice and correctional reforms during the 2017 Legislature include creating the new, professional parole board with extensive criminal justice knowledge. The board will use new tools and work with the Department of Justice to create a clear path for inmates and render consistent decisions.

PART 3: Ex-cons: Sentencing reforms could offer better pathway to freedom

Criminal offenders in Montana sometimes spend years on probation, even after they’ve had a clean record, a job, and an uneventful life for some time. Part of the reforms passed by the 2017 Legislature would free them from that supervision — a move that offenders say is a step in the right direction.

But two former offenders who spoke with MTN News say the system — and, society in general — still have a lot of roadblocks that need to be removed or altered to help ex-cons successfully re-enter life after prison and probation.

PART 4: Private contractors a key part of correctional reforms

As Montana launches an ambitious push to reduce the number of criminal offenders in its correctional system, private contractors running multimillion-dollar parts of the system are a vital link in those changes.

State corrections officials say they want to make sure the prison system and its contractors are on the same page of creating a clearer path for offenders to avoid prison, or get out of prison and the correctional system, once they meet certain requirements.

Contractors who spoke with MTN News said they’re on board with the overall goal, and welcome any scrutiny of their programs. But they also say it’s up to the state to call the shots.

LIVINGSTON- A Livingston man is facing charges for allegedly plotting to throw a homemade explosive device into the police station, according to the Livingston police chief on Wednesday.

Bruce Anthony Flack, 45, was arrested over the weekend and faces charges related to possession of explosives.

According to Chief Dale Johnson, a witness told police that Flack claimed he made an explosive device using a Tylenol bottle and nails.

The witness reported that Flack was angry about prior arrests and was seeking revenge on the police, according to Johnson.

Johnson could not identify what recent arrest Flack may have been angry about, but Flack does have a prior conviction in Park County for robbery.

“We deal with him a lot,” said Johnson.

When police searched Flack’s home over the weekend, they discovered a bottle filled with gun powder, screws, and a fuse.

It’s unclear if the device was actually capable of destruction, but it was confiscated as an explosive.

Johnson said on Wednesday that he believed Flack is in custody.

BILLINGS – Montana’s former Republican House majority leader from Billings pleaded guilty on Tuesday to federal drug distribution charges.

Michael Lange, 56, pleaded guilty in U.S. District Court in Billings to one count of possession of methamphetamine with the intent to distribute and one count of conspiring to distribute methamphetamine.

There is no plea agreement in the case.

The investigation began in 2016, when agents with the Eastern Montana Drug Task Force learned that Lange was distributing a large amount of methamphetamine in the Billings area.

During that same time, agents with the Wyoming Division of Criminal Investigation in Sheridan conducted a buy-and-bust operation for four ounces of methamphetamine from dealers who said Lange was their main supply source.

Agents followed up on this information and executed a search warrant on Lange’s residence. In Lange’s house, agents found 1,202 grams of methamphetamine, 442 grams of cocaine and $27,400 in cash.

Lange and his co-defendant, Jose Soltero, were interviewed by law enforcement.

Soltero admitted to assisting Lange in eight drug deals with people in California, according to court documents.

Lange admitted he obtained about 20 pounds of methamphetamine from Soltero and stated that 17 pounds of the drug were given to another person for distribution. Lange said he sold the remaining three pounds.

Lange, who was elected as a state representative from Billings in 2002, was ousted in 2007 after a profanity-laden outburst.

Lange lashed out at former Democratic Gov. Brian Schweitzer, calling him a “son of a bitch,” which was widely viewed on YouTube.

A date for sentencing has yet to be set.

BILLINGS (AP) — The federal government is looking to keep over $20,000 seized during a drug bust in Yellowstone National Park.

Assistant U.S. Attorney Stephanie Hambrick filed a civil forfeiture complaint Sept. 6 seeking to obtain the $20,337 currently in the hands of the Drug Enforcement Administration.

According to court documents, the money was seized July 8 after a Yellowstone National Park ranger stopped a vehicle with two men inside for speeding where officials later found marijuana. Both men were sentenced to probation for simple possession of a controlled substance.

According to court documents, Jacob Dotson, says $11,000 of the money was his. Dustin Alvis says $10,000 belong to him.

Hambrick says in the complaint that the money was intended to be used to purchase drugs. The men will be able to contest the forfeiture.

BILLINGS – Tanner Cook of Glasgow is facing several criminal charges after allegedly assaulting a Valley County Undersheriff with a metal pipe, Valley County Sheriff Vernon Buerkle said Tuesday.

Cook, 20 years old, was charged Monday in Valley County Justice Court with attempted deliberate homicide, assault with a weapon, aggravated assault, assault on a peace officer, criminal mischief, resisting arrest, and disorderly conduct.

According to Buerkle, deputies were called to a domestic disturbance at a trailer park just outside of Glasgow at around noon last Friday. Neighbors said that Cook and his girlfriend were fighting.

When the first deputy arrived, Cook allegedly came out of the trailer armed with a metal pipe and began hitting the patrol car. The officer called for back-up, and Cook then reportedly assaulted him with the pipe.

The Undersheriff sustained several blows to the head, according to Buerkle. He did not release the Undersheriff’s name.

The two law enforcement officers were able to subdue Cook with a Taser.

The Undersheriff was taken to the emergency department of a Glasgow hospital where he was treated for a head injury and later released. According to Buerkle, the Undersheriff is not yet able to return to duty because of his injuries.

Cook is being held at the Valley County Detention Center on a $500,000 bond.

Buerkle said this wasn’t law enforcement’s first encounter with Cook, who was out on bond for a previous offense at the time of this incident. Cook was arrested in July for a domestic disturbance and later charged with assault.

The Valley County Sheriff’s Office and Glasgow Police Department are investigating.

Last month, a pair of inmates at the jail in Glasgow was charged with assaulting a female detention officer in an attempt to escape.

Buerkle said on Tuesday that the guard has since recovered.

High school shooting in Washington state kills 1, injures 3

ROCKFORD, Wash. (AP) — A shooter opened fire at a high school in a tiny town in Washington state Wednesday, killing one student, injuring three others and sending worried parents to the school in a frenzied rush, authorities said.

Brian Schaeffer of the Spokane Fire Department told reporters that one child died at Freeman High School in Rockford, south of Spokane, while three injured victims were taken to a hospital and expected to survive.

“The shooter has been apprehended and is taken into custody,” he said.

Schaeffer, who didn’t release any information about a possible motive or the age of the suspect, said the shooting was especially hard for first responders, many of whom have children at the school.

A two-lane road into the community of about 500 people near the Idaho border was clogged with vehicles. Some people abandoned their cars on the street to make it to their children.

Cheryl Moser said her son, a freshman at Freeman High School, called her from a classroom after hearing shots fired.

“He called me and said, ‘Mom, there are gunshots.’ He sounded so scared. I’ve never heard him like that,” Moser told The Spokesman-Review newspaper. “You never think about something happening like this at a small school.”

Providence Sacred Heart Medical Center and Children’s Hospital received three pediatric patients, spokeswoman Nicole Stewart said. They were in stable condition and surrounded by family, she said.

Authorities didn’t immediately release the ages of the victims.

Stephanie Lutje told The Associated Press that she was relieved to hear her son was safe after his high school near Freeman was put on lockdown. She commended the school district for its communication with parents.

“It’s been amazing, within probably 15-20 minutes of hearing about it, I’d already received a phone call, I’d already received a text message saying that their school is OK,” she said.

She still worried for others she knew, including a co-worker who had yet to hear from her son, a sophomore at Freeman.

“My stomach’s in knots right now,” she said.

Gov. Jay Inslee said in a statement that “all Washingtonians are thinking of the victims and their families, and are grateful for the service of school staff and first responders working to keep our students safe.”

HELENA – A Great Falls suspect received a 120-year prison sentence for his part in a shootout late last year in the Wolf Creek area.

Kaleb Daniels was convicted in July after a two day trial for attempted deliberate homicide, aggravated burglary and tampering with evidence.

Daniels and Jory Strizich were allegedly involved in a confrontation with a cabin owner in the Wolf Creek area on Dec. 28. Daniels and Strizich had allegedly broken into the cabin when the owner and his wife arrived at the scene.

In the confrontation that followed, Daniels and the cabin owner exchanged gunshots before Daniels fled the area on foot. He was arrested later that day after trying to break into another Wolf Creek home.

In district court Wednesday, Lewis and Clark County Attorney Leo Gallagher said Daniels is a “lethal individual” who was under the influence of meth and alcohol on the day of the shooting.

Kaleb E. Daniels

Defense Attorney Steven Scott told Judge Mike McMahon that his client is a young man with a poor record and a poor upbringing by two drug affected parents.

Daniels apologized to the court for his actions and asked for a second chance.

“The court is concerned for the public safety if you are put back on the street,” Judge McMahon told Daniels. “Justice doesn’t allow the court to put a person like you on the street.”

McMahon sentenced Daniels to 60 years in prison for attempted deliberate homicide, 40 years for aggravated burglary and 20 years for tampering with evidence.

Jory Strizich

No time was suspended from the sentence. Daniels could be eligible for parole in 30-years.

He has prior convictions in Cascade County for possession of dangerous drugs and theft.

Jory Strizich is set to go on trial in this case in October.

Man stabbed in early morning robbery, teen suspect in pair of robberies behind bars

PREVIOUS: An 18-year-old man is behind bars, charged with robbery after a pair of crimes were reported late Tuesday night and Wednesday morning that left one victim with multiple stab wounds.

Matthew A. Anderson, 18, appeared in Gallatin County Justice Court Thursday morning on felony robbery charges.

Anderson was arrested after Bozeman Police officers tracked one of the victim’s cell phone to a car that Anderson was traveling in. Gallatin County Sheriff’s Office deputies located him near Belgrade.

According to charging documents, Bozeman Police officers responded to a report of an assault that happened near the intersection of No. Bozeman and E. Mendenhall St. The victim reported that his wallet had been stolen during the incident.

The victim told police that he had been walking home from the downtown area at approximately 11 p.m. when he noticed a gold-colored car driving aggressively. The vehicle pulled into a nearby parking lot near the intersection.

As the man approached the intersection, he was assaulted from behind by a man, who allegedly pulled victim’s shirt over his head and struck him approximately 10 times, demanding his wallet and phone.

The victim gave the suspect the items and the assailant got into the car and drove away, northbound on N. Bozeman.

Then, at approximately 2:35 a.m. Wednesday, Bozeman Police officers were dispatched to a Bozeman hostel on Main St. for a report of a  robbery. A man was found to have a towel over his shoulder, with visible blood on it and on his clothing.

The man told police he had been robbed by a man while in the alleyway of N. Black Ave. and that during the robbery he had been stabbed.

The victim said a woman accompanied the man who was robbing him, and the pair left in a gold-colored sedan after the assault.

The second victim was transported to Bozeman Deaconess Hospital where three stab wounds to his body were treated.

The victim told officers that he was listening to music when he saw a man and woman walking near him holding hands. When the couple was behind him, he heard the man demand his money. The victim told the man he had no money at which point the man began stabbing him. The man and woman then fled the area in the vehicle.

The victim described the man and woman as both having dirty blonde hair, being approximately 17 and 15 years old, respectively, with the girl’s hair shorter than the man’s and the man wearing a rock band shirt with possibly a skull on it.

The victim provided officers with his cell phone number and reported the pair stole his National Guard camouflage backpack.

Police had an emergency locate conducted on the phone which indicated the phone was potentially traveling west, near Belgrade.

A pair of deputies were notified and observed a silver car parked near the side of the road, near the intersection of Green Tree Dr. and E. Vela Rd.

A juvenile girl was in the driver’s seat and Anderson was in the passenger seat. When asked to exit the vehicle, blood was observed on Anderson’s hands. A pat search found 2 knives in Anderson’s pockets, with one having what looked to be dried blood on it. A National Guard backpack was seen sitting on the center console of the car.

During an interview, Anderson told officers that he and the girl were in downtown Bozeman to serve as a taxi or Uber for intoxicated people leaving the bars. Anderson claimed he approached the second victim to help him, placing his backpack in the car, when the victim tried to stab Anderson. Anderson reportedly claimed that he took the knife from the victim and stabbed him several times.

Anderson denied any involvement in the first robbery but later stated there was a verbal exchange between him and the victim regarding the girl. Anderson then acknowledged pulling the victim’s shirt over his head and striking the victim in the back of the head approximately 10 times and took his cellphone and wallet.

The victim’s driver’s license and credit card were later located where Anderson said they had been discarded.

The juvenile girl was also interviewed and waived her Miranda rights. She reportedly told investigators that she and Anderson had been trying to provide intoxicated people rides home in exchange for money. She said that Anderson had gotten into a fight with a man and that she had driven Anderson away in her car.

She also allegedly said that later Anderson had approached another man and appeared to be getting assaulted by the man so she exited her car, carrying a machete to prevent Anderson from losing the fight.

She acknowledged that she was aware that Anderson used a specific knife in each attack, purchased by her, that she kept in her car. She also reportedly told officers that Anderson admitted to stabbing the second victim as she drove away from the assault.

Anderson remains at the Gallatin County Detention center and is being held on no bond. He’s been held on two charges of robbery and one charge of unlawful restraint.

This is a developing story and will be updated as more information becomes available.
