Denver man sentenced to more than 20 years in prison for trafficking in Billings

BILLINGS – A Denver resident who admitted to trafficking meth in the Billings community was sentenced Thursday to 20 years and eight months in federal prison and five years of supervised release, according to a press release issued by U.S. Attorney Kurt Alme.

Nathan Thomas Trujillo, 42, pleaded guilty in December to conspiracy to possess with intent to distribute meth, possession with intent to distribute meth and possession of a firearm in furtherance of a drug trafficking crime.

According to the press release, beginning in August 2018 drug task force agents began investigating a Billings area dealer, later identified as Trujillo, who was living under a stolen identity to avoid arrest on an outstanding warrant. Agents made multiple drug buys from a co-conspirator and learned that Trujillo traveled to Denver to obtain pound quantities of drugs for re-distribution in the Billings area.

Agents executed search warrants on Trujillo’s vehicle and apartment. From the vehicle agents seized about 15 ounces of meth from his vehicle, a 9mm pistol, a digital scale and plastic baggies. The 429 grams of meth is the equivalent of about 3,432 individual doses.

Agents also found additional firearms, illegal drugs and drug paraphernalia. From Trujillo’s apartment, agents seized another firearm and more drug paraphernalia.

Bozeman childcare facility closed after owner arrested on reported drug charges

BOZEMAN – A Bozeman child care center is closed indefinitely after its owner was arrested on drug charges in Illinois.

A sign on the door of Drop-A-Tot Child Care said the facility is closed.

MTN has confirmed that Amber Widner, 36, is the owner of the business.

Widner was arrested by Illinois State Police after a traffic stop reportedly turned up 143 pounds of marijuana, 14 pounds of mushrooms and nine pounds of cannabis wax.

According to a news release from ISP, Widner was stopped on June 12 on Interstate 74 near south Bloomington, Illinois.

The trooper called in a police dog after reportedly seeing signs of suspicious activity. Police said the canine alerted to an odor of illegal drugs.

HELENA – The Illinois State Police arrested a Bozeman woman after a traffic stop that they say turned up 143 pounds of marijuana, 14 pounds of mushrooms and nine pounds of cannabis wax.

According to a news release from ISP, Amber Widner, 36, was stopped on June 12 on Interstate 74 near south Bloomington, Illinois.

The trooper called in a police dog after reportedly seeing signs of suspicious activity. Police said the canine alerted to an odor of illegal drugs.

Widner faces six charges, including Controlled Substance Trafficking and Cannabis Trafficking, according to the McLean County, Illinois Circuit Court.

A McLean County Judge set bond at $75,000.

Lewis & Clark County authorities searching for armed & dangerous suspect

(HELENA) The Lewis and Clark County Sheriff’s Office is asking people to be on the lookout for a suspect, believed to be armed and dangerous.

They issued an alert Friday for 38-year-old Bruce Alan Garay. Garay is described as 5 feet, 6 inches and 170 pounds, with brown hair and brown eyes. He was last known to be in the Helena area on Tuesday, June 25.

Sheriff Leo Dutton said Garay is wanted on multiple felony warrants, including two counts of strangulation-partner or family member assault in Lewis and Clark County.

The U.S. Marshals Service and the Missouri River Drug Task Force are cooperating on the case.

If you have any information about Garay, you are asked to call the Marshals Service at (406) 247-7030 or contact local law enforcement. If you see him in the Helena area, authorities advise you do not approach him, and that you call 911.

Lewis and Clark County man charged with multiple counts of rape

HELENA – A 54 year-old Lewis and Clark County man is accused of raping another man.

Richard William Wilson appeared via video in justice court Friday afternoon.

According to court documents, the man told investigators Wilson told him he wanted to have sex with him on June 27th.

The man says he declined, but Wilson then pulled him into a room and raped him.

Court records say during the investigation detectives learned of another alleged assault in April.

Wilson has been charged with four counts of sexual intercourse without consent.

The judge set bond at $25,000.

Livingston woman accused of meth possession, leaving 3-year-old in truck

BOZEMAN – A Livingston woman is accused of meth possession and leaving her 3-year-old son alone in her truck while she was in a Bozeman motel room for at least 1 ½ hours on Sunday.

According to court documents, Bozeman police arrested 30-year-old Kimberly Sherrell around 5:30 a.m. Sunday after a welfare check was requested for a child under the age of 5 who had been left in a truck for at least 90 minutes.

The responding officer said in court documents that when he performed the welfare check at the motel on Wheat Drive, he found a young boy asleep in the back of the reported vehicle. The officer said the truck was not running but keys were in the ignition, music was playing, and all the doors were unlocked.

The officer opened a truck door to check on the child, court documents state, and immediately noticed the odor of feces and urine. The officer said the boy had bumps that looked like mosquito bites on his forehead and dark circles under his eyes.

An ambulance arrived and took the boy to Bozeman Deaconess Hospital for further evaluation, followed by another police officer.

The responding officer requested assistance from Park County deputies as the truck was registered to a Livingston address. The deputies were able to locate the child’s great-grandmother, according to court documents, who confirmed the boy is 3 years old and Sherrell is the mother.

Officers located Sherrell in a room at the motel with another man. She reportedly gave no explanation for why her son was left in the truck and said she had been in the room for about 90 minutes. The man in the room allegedly said Sherrell had been there since around 2:30 a.m., which would have placed her in the room for approximately 3 hours.

Sherrell was arrested for endangering the welfare of children and transported to the Gallatin County Detention Center. When her possessions were searched, officers allegedly found two glass pipes and two baggies containing a substance that tested positive for methamphetamine. Sherrell was additionally cited for criminal possession of dangerous drugs.

Sherrell appeared in Gallatin County Justice Court on Monday, where her bail was set at $10,000. She is not to have any contact with the child, who is currently in the custody of other family members.

Sherrell’s next court appearance is scheduled for July 19.

Jury finds Bridger man guilty of raping girl, woman

RED LODGE- A Bridger man was found guilty Friday on six counts related to one rape of a 4-year-old girl and another rape of a woman immobilized following a car crash, according to the Carbon County News.

Gene Deveraux was found guilty in Carbon County District Court in Red Lodge of all charges, which included one count of sexual assault and three counts of sexual intercourse without consent.

The jury took just over 90 minutes to come to its verdict, the Carbon County News reported. The trial began earlier this week.

Tears of joy could be heard from one side of the courtroom and tears of sorrow from the other side as the verdict was read out, according to the paper. Sentencing will take place at a later date.

Charges were first filed in January 2017 against Deveraux in the case of raping the girl. The girl had told police Deveraux molested her for several years starting in 2005 when she was 4 years old.

She went to authorities because she learned he might be living with other young children, according to court documents.

During the course of that investigation, detectives learned of the second victim.

The woman told police she didn’t want to have sex with Deveraux because she was in pain from the pelvis and leg injuries she suffered in the crash, according to authorities.

She told authorities he didn’t care, and she was afraid of physical retribution if she refused.

Prosecutors charged Deveraux with the second rape in March 2018.

MT man admits to wire fraud in $43 million bank loan scheme

A Billings businessman accused earlier this year of defrauding nearly a dozen banks across the country in a scheme to buy oil tankers admitted Tuesday in New York to a federal charge of wire fraud.

Todd Capser, 47, appeared before a judge in the Southern District of New York and pleaded guilty to count two of a three-count indictment filed in early May.

According to court records, Capser is scheduled to be sentenced on Nov. 8.

Capser was initially charged with conspiracy to commit wire fraud, wire fraud and aggravated identity theft in what federal prosecutors described as a scam to get a $43 million loan from a Canadian bank to buy two oil tankers.

In March 2018, a shipping firm managing the two tankers fell $1 million behind on loan payments, so Capser went to other banks seeking loans, including one in New York.

According to the indictment, the scheme began in January 2016 and lasted through April 2019. Capser obtained “money and property by means of false and fraudulent pretenses…using emails, phone calls, and other means, made false and misleading representations regarding, among other things, an investment portfolio worth tens of millions of dollars…for the purpose of obtaining tens of millions of dollars in loans…,” according to court records.

Capser was a prominent member of the Billings community, serving as state director for former U.S. Sen. Conrad Burns of Montana in the early 2000s and as a former trustee at St. Vincent Healthcare. He also coached track at Billings Central High School.

Man accused of exposing himself near children at Bozeman rec area

BOZEMAN – A man is facing charges after allegedly exposing himself, with several children present, at the East Gallatin Recreation Area in Bozeman on Monday.

Bozeman police arrested 28-year-old Evan Earl Larrabaster Tuesday on two counts of indecent exposure. Larrabaster appeared in Gallatin County Justice Court on Wednesday, where his bail was set at $25,000.

Court documents state Bozeman police officers responded to the rec area around 4:15 p.m. Monday after reports of a naked man walking around the park and masturbating in his truck.

The truck reportedly left the scene before officers arrived, but callers provided license plate information that showed Larrabaster to be the registered owner.

A Bozeman police detective continuing the investigation on Tuesday spoke to a witness, according to court documents, who said he and other witnesses could clearly see Larrabaster in the driver’s seat of his truck with the door open.

The witness said he was with two adult women and 10 children ranging in age from 1 to 12 years old. The witness also said the distance from his group to Larrabaster’s truck was three parking spaces.

The detective said in court documents that when he spoke to Larrabaster by phone on Tuesday, Larrabaster admitted he was the man in the incident, said he was aware he has a problem, and was seeking counseling.

Larrabaster reportedly has two prior convictions for indecent exposure in Bozeman Municipal Court.

Officers attempted to locate Larrabaster throughout Tuesday, eventually arresting him at his residence around 11 p.m.

If Larrabaster is able to post bond, he must not go anywhere children frequent, including the East Gallatin Recreation Area, and he is to have no contact with children under 18.

Several people implicated in scheme to smuggle drugs, contraband into Cascade County jail

Several people have been implicated in an alleged scheme to smuggle drugs and other contraband into the Cascade County Detention Center.

In June of 2019, Russell Country Drug Task Force detectives and Cascade County Sheriff’s deputies began investigating the smuggling of dangerous drugs and illegal articles into the Cascade County jail located at 3800 Ulm North Frontage Road.

Cascade County Sheriff Jesse Slaughter reported the scheme involved close coordination between inmates and individuals who were not in custody.

The smuggling would typically occur as follows: Individuals not in custody would bond an inmate with a low bond out of jail. When the inmate got out, the inmate would be taken to a location where he would be provided with different “packages.”

The “packages” were made of either balloons, condoms, or saran wrap, which contained different illegal articles. The illegal articles in packages varied, but would typically include methamphetamine, Suboxone, marijuana, tobacco, lighters, and rolling papers.

After the bonded out inmate was provided the packages, they would then swallow the packages or hide the packages in an orifice. Once the inmate was loaded with contraband, the inmate was required to commit a new crime, or otherwise engage in conduct, which would result in their bond getting revoked or them being re-arrested. The inmate would then return to the jail, according to Sheriff Slaughter.

Law enforcement determined that a particular group of inmates participated in the scheme to traffic contraband into the detention center. Those inmates included Franklin Caplette, Guadalupe Galicia, Owen Hawley, Richard Houle, and Anthony Beltran, according to Cascade County Sheriff Jesse Slaughter.

Sheriff Slaughter also named the individuals outside of the jail who are accused of facilitating the trafficking. Those people include Traci Lamere, Cory Gay, Katrina Palmer, Lacey Hawley, Antonio Lamere, and Ryan Beltran. Kalled Jaha, Anthony Beavers, and William Claus were also involved on the outside, as individuals who were not in custody.

Detectives from the HITDA (High Intensity Drug Trafficking Area program) included the Cascade County Sheriff’s Office, Great Falls Police Department, Conrad Police Department and the U.S. Marshals, who all assisted in the arrest of several suspects during the investigation.

At this time, Traci Caplette and Kalled Jaha have not been arrested and have active warrants. Sheriff Slaughter asked for anyone with information concerning Caplette and Jaha to contact the Cascade County Sheriffs Office 406-454-6978 or call 911.

Sheriff Slaughter is holding a press conference regarding the alleged scheme and investigation at 3 p.m. Wednesday. We will update you with any new information.

LCSO continue search for black SUV connected to homicide investigation

HELENA – The Lewis and Clark County Sheriff’s Office are still searching for a two door SUV connected to a recent homicide investigation.

The public is asked to be on the lookout for a black 1990’s Chevy S-10 blazer with larger tires and custom black rims.

Sheriff Leo Dutton says there is a good chance the SUV is no longer in the area and asks the public to share the picture with people across the state.

Another vehicle related to the case–a red 1975 Ford truck– was located Tuesday evening thanks to the public calling in after seeing the truck on the news.

If anyone has information about the SUV or the homicide investigation they are asked to contact Detective James Ward at 406-457-8866.

People can also leave tips anonymously by calling Crimestopers at 406-443-2000.

Do not attempt to make contact with any occupants of the vehicle if located.

“We appreciate the information that you have,” said Dutton. “If you think you saw something or if you think you know something that happened on Beck Street on Sunday give us a call.”

Thomas Ralph Bristow has been arrested on the charge of deliberate homicide for the alleged incident at a property on Beck Street east of Helena.

According to court documents, Bristow is accused of shooting a person after an altercation connected to a drug deal.

His bond was set at $200,000.

Billings massage parlor owner pleads guilty to federal charge related to prostitution ring

BILLINGS- A Billings massage parlor owner has agreed to plead guilty to one count related to a sex-trafficking ring involving his two businesses.

Scot Donald Petrie signed on Tuesday the agreement to plead guilty of transporting a woman from Nevada to Billings to work in prostitution at his parlor, according to federal court documents.

That charge carries a maximum of 10 years in federal prison, a $250,000 fine and an additional $5,000 special assessment and five years to life supervised release.

A trial had been scheduled for Aug. 12.

In exchange, prosecutors agreed not to pursue charges of conspiracy and coercion and entitlement, which could have added 25 years to Petrie’s sentence.

Petrie was arrested in April on suspicion of what authorities said was a prostitution ring at his two spas, King Spa and A Spa in Billings.

Charging documents indicated authorities believed Petrie was working with others to conduct the prostitution ring, though prosecutors have not brought charges against anyone else.

Petrie is also required to give up ownership of King Spa as part of the plea agreement.

Lewis and Clark Co. Sheriff-Coroner ID’s homicide victim

HELENA-The Lewis and Clark County Sheriff-Coroner says Cory Leo Housel was the man who was murdered at a residence on Beck Street, east of Helena, earlier this week.

Sheriff Leo Dutton said Wednesday at 5:07 p.m. dispatch received a phone call that an individual had found a body, later identified as Housel, east of Canyon Ferry Lake in a remote location.

An autopsy currently being performed in Missoula.

On Thursday evening, a Black SUV wanted in connection to the homicide case was located in Butte.

33-year-old Joshua Henry of Butte and 26-year-old Kristi Iverson have been arrested on charges of tampering with or fabricating evidence in connection to the homicide case.

The two are currently being held in Anaconda and will be transported to Lewis and Clark County to face charges.

Law enforcement was able to locate the vehicle thanks to an anonymous crime stoppers tip.

Bozeman man appears in court after reportedly discharging gun while law enforcement investigate disturbance

BOZEMAN – A Bozeman man is facing a $100,000 bond and several charges after Gallatin County Sheriff’s deputies responded to a domestic disturbance on Wednesday, July 3.

Gregg Alan Fuller, 48, was charged with partner family member assault, criminal endangerment and tampering with evidence in Gallatin County Justice Court Friday morning.

According to charging documents, Gallatin County Sheriff’s deputies responded to a call shortly after midnight on July 3. A reporting party called law enforcement stating that Fuller had smashed her phone and was “going to get guns.”

When the deputies arrived at the scene, they allegedly saw Fuller near a vehicle in the yard. When ordered twice to show his hands, Fuller reported stated “No” and entered the vehicle. After a short time, Fuller then exited the vehicle and ran into the house with the deputies pursuing.

When ordered to stop or he’d be tased, Fuller reportedly said “No” and ran up the stairs as a deputy deployed a taser, which did not make contact with Fuller. A few seconds later, law enforcement heard what sounded to be a single gunshot upstairs.

The victims were escorted out of the home and a negotiator spent the next several hours attempting to talk Fuller out of the home but was unsuccessful. Since the known charges at that time were misdemeanors, law enforcement left the scene. Fuller was later contacted and brought into the Law and Justice Center.

During an interview with investigators, Fuller stated that he had run upstairs and grabbed a .45 cal handgun after law enforcement had chased him into the house. He reportedly stated that he tripped over his dog in the bedroom and accidentally discharged the firearm as he was falling. Fuller told officers after he woke up in the morning he patched and repainted the bullet holes in the door and adjoining bedroom wall because he did not want his kids to see the damage. Court documents say this action meets the definition of tampering with physical evidence.

For the PFMA, Fuller faces between 24 hours to 1 year, possible 40 hours of anger management and between $100 to $1,000 in fines.

For criminal endangerment, Fuller faces up to $50,000 in fines and up to 10 years in prison.

For tampering with evidence, up to $10,000 in fines and, again, up to 10 years in prison.

The judge set his bond at $100,000, while the state originally requested $250,000 due to his past cases of similar crimes, including a mirroring standoff that happened in June that is still pending in court.

Fuller was also ordered to GPS monitoring, must stay at least 1,500 feet away from the home and from the victim/child. He also cannot have any weapons and will get a one-time escort to the home for personal belongings, if he posts bond.

Fuller reportedly is a former commercial pilot who was released due to a medical condition.

His next court appearance is set for July 19.

Whitish charged with 9 counts of criminal endangerment, assault with a weapon

GREAT FALLS – A man is facing 10 felony charges for allegedly shooting at the ground with several people nearby during an early morning incident in Great Falls.

Kristoffer Cole Whitish, 25, has been charged with one felony count of assault with a weapon and nine felony counts of criminal endangerment after an incident that occurred just after 12 a.m. on July 5.

Court documents state the Great Falls Police Department responded to the 600 block of 13th Street North for a report of a man pulling a firearm on another man before discharging the gun into the ground.

When officers arrived, the victim stated Whitish had previously been at the residence looking for someone, but left.

The victim said when Whitish returned, he was driving recklessly and stopped in the street. The victim told officers he warned Whitish to stop being reckless as there were children outside.

Whitish and the victim then began arguing before getting into a physical fight, which was broken up by other people at the house, according to court documents.

Whitish then allegedly pulled a handgun out of his truck and started yelling. The victim told officers Whitish pointed the gun at him before shooting at the ground.

Court documents state Whitish was disarmed during another altercation. He then left the scene.

When Whitish was arrested, he admitted to grabbing the handgun and shooting the ground.

While Whitish does not appear to have a criminal record, prosecutors requested bond be set at $75,000 due to Whitish presenting “a clear danger to the community based upon his lack of ability to control his emotions to the point he feels it appropriate to pull a deadly weapon on people.”

Fugitive captured in Montana by U.S. Marshals, one of ATF’s ‘Most Wanted’

BILLINGS – On July 3, The U.S. Marshals in Montana arrested one of the ATF’s 15 most wanted fugitives by the ATF Kansas City Field Division on an outstanding warrant, out of the Northern District of Iowa for felon in possession of a firearm.

Michael Duane Strain, 62, a sovereign citizen who has a criminal history of obstruction, contempt of court, trespass, fleeing a peace officer in a motor vehicle, possession of a short-barreled shotgun, and possession of explosive devices, was taken into custody around 6 p.m. without incident at a remote ranch approximately two hours from Billings.

ATF had contacted Marshals June 26, with information that Strain was possibly in the area.

“As soon as the information was received it was transferred to our team on the ground,” said U.S. Marshal for Montana Rod Ostermiller. “We were able to act on that information immediately and begin working to get this dangerous fugitive into custody. This is a great example of the close working relationship we have with the ATF.”

After the arrest, ATF was notified and put in touch with the ranch owner. They will conduct a search of the property.

Strain was transported to Big Horn County jail for his initial appearance and arraignment.

“This case is a perfect example of our outstanding partnership with the United States Marshals Service. We appreciate their commitment to removing dangerous fugitives such as Michael Strain from our communities, and we’ll continue to work together to protect the public,” said Special Agent in Charge of the ATF’s Kansas City Filed Division, Marino Vidoli.

ATF agents in the Northern District of Iowa indicted Strain Oct. 19, 2011, on charges of possession of a firearm as a felon and subsequently turned apprehension authority over to the USMS.

The last known address for Strain in October 2011 was in Elma, Iowa. Late 2011 through 2012 information was developed by the USMS placing Strain in southeast Minnesota, and in 2014, information was developed indicating Strain had likely moved west and was possibly in Wyoming or Utah, likely residing on a ranch.

In 2018 the USMS Northern District of Iowa distributed a press release in June highlighting the mobile TIPS app and highlighted Strain as a fugitive being sought by the Marshals

Man accused of burglary allegedly says he was investigating ‘weird things’ in Bozeman

BOZEMAN – A man was arrested on Sunday after witnesses reportedly saw him going through several residential back yards and garages in Bozeman.

According to court documents, around 4 p.m. Sunday, police officers located and questioned 39-year-old Eric Sellegren of Bozeman after witnesses say a man matching his description was walking through backyards and going through peoples’ belongings near the intersection of Broadway Avenue and Davis Street.

Sellegren allegedly told officers he was the person witnesses reported and that “weird things are going on in Bozeman” that were his duty to investigate. The reporting officer said in court documents that Sellegren couldn’t give an answer when asked what weird things were going on.

The reporting officer said he placed Sellegren under arrest for criminal trespass and disorderly conduct. According to court documents, the officer found a pair of pruning shears with Sellegren’s belongings when he was booked at the Gallatin County Detention Center. Sellegren allegedly admitted that he took the shears from inside an unlocked shed.

The officer said he made contact with the resident of the property where the shed was located, who confirmed a pair of shears was missing. Sellegren was additionally charged with burglary.

Sellegren appeared in Gallatin County Justice Court on Monday and faces up to 20 years in prison if convicted. His bail was set at $10,000.

Details emerge in Mission Valley high-speed chase

POLSON – We are learning more information about a high-speed police pursuit through the Mission Valley that landed a man in jail.

Lake County Sheriff Don Bell says that Matthew Harold VanValin, 29, of Missoula was arrested after a pursuit that began late Sunday night in Ronan and ended 36 miles later at the Grey Wolf Casino in Evaro.

Missoula County Sheriff’s Office deputies put stop sticks out near mile marker 10 on US Highway 93 North and flattened the tires on the stolen vehicle. A short foot pursuit ensued and VanValin was taken into custody.

No injuries were reported and the pursuit ended at about midnight.

Sheriff Bell states the pursuit started at about 11:15 p.m. when a Lake County deputy noticed a vehicle in Ronan that fit the description of a stolen vehicle out of Missoula.

The deputy verified the plate and when the vehicle came back stolen the deputy activated his emergency lights and siren. The driver of the stolen vehicle — later identified as VanValin — then fled the stop at a high rate of speed heading southbound out of Ronan.

The Ronan Police Department, CSKT Tribal Police, Montana Highway Patrol, and the Missoula County Sheriff’s Office assisted the Lake County Sheriff’s Office in apprehending VanValin, according to Sheriff Bell.

VanValin is currently behind bars in the Missoula County Detention Center.

Child killed in hit-and-run crash near Hamilton, suspect arrested

HAMILTON – A man has been arrested and is facing a negligent homicide charge after a 10-year-old boy died in a Sunday afternoon hit-and-run incident in Hamilton.

Ravalli County Sheriff Steve Holton said Joseph McNamara, 59, was arrested in a Hamilton home on Sunday evening. McNamara is being held in the Ravalli County jail.

Holton said Ravalli County deputies, Montana Highway Patrol troopers, Hamilton police officers, US Forest Service law enforcement, the Missoula County Sheriff’s Office, and the US Marshal’s Service worked together to find McNamara.

Information obtained during a traffic stop led to locating McNamara at a residence in Hamilton after a six-hour search.

The Montana Highway Patrol is investigating the hit-and-run and will release further details as the investigation proceeds.

Holton thanked everyone who called in with tips and information on the suspect and called attention to the excellent work done by the cooperating law enforcement agencies to quickly locate and arrest the suspect.

“The strong investigative work and partnerships between all of the assisting agencies is what brought the suspect into custody so quickly,” Sheriff Holton said.

Former Montana tribal head admits to travel fraud scheme

BILLINGS- The former president of the Northern Cheyenne Indian Tribe is admitting to devising a complicated travel fraud scheme to take 20 thousand dollars in reimbursement funds from the tribe.

Lawrence Killsback, 40, pleaded guilty to wire fraud and the false claims conspiracy in Montana federal court.

Killsback worked as the tribe’s health director and then tribal president. Prosecutors say he submitted fraudulent invoices to tribal and state entities claiming travel expenses that were exaggerated or false.

He told investigators at one point that travel fraud happens all the time on the reservation, saying there was a culture of travel fraud.

Another scheme involved Killsback falsifying hotel invoices through a software program. Investigators found 28 trips that involved travel fraud.

He faces a maximum of 20 years in prison.

Bozeman woman accused of meth possession, bear spraying ex-boyfriend

BOZEMAN – A Bozeman woman was arrested on Friday after allegedly possessing methamphetamine and spraying her ex-boyfriend with bear spray during an argument.

Rexilane Doris Peery, 28, appeared in Gallatin County Justice Court on Monday, charged with criminal possession of dangerous drugs. Her bail was set at $2,500.

According to court documents, police responded around 2 p.m. Friday to a report that Peery had bear sprayed someone at an apartment in the 2400 block of West College Street.

The reporting officer noted in court documents that Peery had been involved in two prior cases of bear spraying someone since June 28. Cases are pending for the two prior alleged incidents.

The officer said in court documents the Friday incident involved Peery, her husband, her ex-boyfriend, and another woman who lives at the apartment.

Court documents state that Peery was having an argument with her husband when she attempted to get his backpack out of the ex-boyfriend’s vehicle. Her husband reportedly told the officer he believed Peery intended to spray his backpack with bear spray.

Peery’s husband and ex-boyfriend allegedly tried to stop her from getting the backpack, which caused her to bear spray her ex-boyfriend instead.

The reporting officer said in court documents Peery told him she intentionally deployed the bear spray toward the two men when they began to approach her and was acting in self-defense. The officer noted Peery was outside when the incident occurred and never attempted to get help although there were several people in the area. The officer also said Peery had time to remove herself from the situation since she had to retrieve the bear spray from her purse.

The officer arrested Peery and transported her to the Gallatin County Detention Center. When detention staff searched her property, they allegedly found a pipe with residue that tested positive for methamphetamine.

Peery’s next court date is set for July 26.
